Senior Advocate Rajesh Kshetry has achieved one of his greatest victories today by solving a 32 years-long case. Senior Advocate Mr. Rajesh Kshetry fought the case for over 10 years. His utmost dedication and determination to give justice to Mrs. Gorai and her family finally bore fruit.
Why the dispute?
The dispute had started in the year 1988 between the two contesting parties that is Mrs. Chhaya Rani Gorai and the Burdwan Katoya District College. The matter started when the land of 10 Acres belonging to Mrs. Chhaya Rani Gorai and her family was acquired by the Katoya District College authorities. It is argued that the land that rightfully belonged to the Gorai family was forcibly occupied by the college authorities. The college refused to pay any compensation to the aggrieved Gorai family. As per a witness, the Gorai family hopelessly ran from door to door of the college authorities for the purpose of recovering their land. But everything went in vain. The then Principal of the Katoya District College refused to either hand over the land or pay any compensation to the family. The authorities argued that they needed the land urgently for their college that is the Katoya District College. The distressed Gorai family had no other option left but to knock the door of the Kolkata High Court. Thus, the actual dispute started between the two families.
How was the dispute solved?
Initially the family had received a negligible amount that was supposedly the valuation amount from their land. But it was argued that the amount was very less than what they were entitled to get.
Finally, to the utmost respite of the Gorai family, the matter was taken over by Senior Advocate Mr. Rajesh Kshetry. He litigated the matter in court and made communications with the Government officials over the matter at hand. This ultimately led to the College authorities agreeing to pay the long standing compensation of Rs. 20 Lakhs to the Gorai Family. Additionally, the family was paid Rs. 50 Lakhs. As a result, the family is receiving a total amount of Rs.70 Lakhs as interest. According to Mrs. Chhaya Rani Gorai’s son, their saviour was Senior Advocate Mr. Rajesh Kshetry. It was because of Advocate Kshetry that the family received their due compensation. As per the Gorai family, if it was not for Advocate Kshetry, they would have never received justice.
The Final Respite:-
According Senior Advocate Mr. Rajesh Kshetry, the case was continuously sidelined by the Government even after receiving court orders. The first court order was received back in the year 2011 but the Government did not comply. Finally, in the year 2019 the Court issued a rule for the compulsory payment of the due amount to the aggrieved party. The case was litigated in court by Advocate Kshetry himself. He was adamant for providing compensation to the distressed Gorai family. According to Advocate Kshetry, the case was unnecessarily stretched for such a long period causing deep pain and distress to the family. Advocate Kshetry believes that he has won a war of justice for the elderly Mrs. Gorai who is not only his client but a mother figure to him.
